Terms of Service - Smashrs

1. Acceptance of terms

By accessing or using smashrs.com (the "Platform") you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform. We may update these Terms from time to time; continued use after any change constitutes acceptance of the updated Terms.

2. Description of service

Smashrs provides ATP tennis match analytics, statistical model predictions, player profiles, head-to-head records, and related informational content. The Platform is operated for informational and entertainment purposes only. Nothing on Smashrs constitutes financial, legal, investment, or betting advice.

Smashrs may display links to or odds from Kalshi, a CFTC-regulated prediction exchange. These links are provided as a convenience. Smashrs is not a licensed gambling operator and does not accept bets or wagers. Any activity you undertake on third-party platforms is governed by those platforms' own terms.

3. No guarantee of results

All predictions, probability estimates, and model outputs are generated by automated statistical models and are provided "as is" without warranty of any kind. Past model performance does not guarantee future results. Sports and prediction markets carry inherent financial risk, and you may lose money. Smashrs, its operators, and its contributors accept no liability whatsoever for any financial loss, damages, or other harm arising from your reliance on information provided by the Platform.

4. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use Smashrs. If you use any third-party prediction markets or betting services linked from the Platform, you are solely responsible for ensuring you meet the age and legal requirements of those services in your jurisdiction. Smashrs makes no representation that use of the Platform or any linked service is legal in your location.

5. Account responsibilities

If you create an account on Smashrs you are responsible for:

Maintaining the confidentiality of your account credentials.
All activity that occurs under your account, whether or not authorized by you.
Notifying us immediately at hello@smashrs.com if you become aware of any unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Prohibited use

You agree not to:

Scrape, crawl, or systematically harvest content, predictions, or data from the Platform without our prior written consent.
Reproduce, redistribute, resell, or sublicense Smashrs content or model outputs for commercial purposes.
Attempt to reverse-engineer, decompile, or access the underlying models, algorithms, or source code of the Platform.
Use the Platform in any manner that could damage, overburden, or impair our servers or infrastructure.
Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.

7. Intellectual property

All content on the Platform, including but not limited to text, graphics, logos, model outputs, and software, is the property of Smashrs or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. No other rights are granted.

ATP match data used by the Platform is sourced from publicly available records. Smashrs is not affiliated with or endorsed by the ATP Tour.

8. Third-party links and services

The Platform may contain links to third-party websites or services, including Kalshi. These links are provided for your convenience only. Smashrs does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party services is at your own risk and governed solely by those services' own terms.

9. Disclaimers and limitation of liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Smashrs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or financial losses, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

10. Responsible gambling

Smashrs encourages responsible use of prediction markets. Never wager more than you can afford to lose. If you or someone you know may have a gambling problem, please seek help. The National Problem Gambling Helpline is available 24/7 at 1-800-522-4700 or at ncpgambling.org.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Cook County, Illinois.

12. Changes to these terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top of this page when changes are made. For material changes, we will provide notice to registered users via email. Your continued use of the Platform after any modification constitutes acceptance of the updated Terms.
